The employer must provide supporting evidence that demonstrates the prospective foreign worker have at least three years of teaching or research experience in their field, along with evidence of international recognition and other qualifications necessary to obtain the Green Card classification. USCIS will then review the petition and supporting documents to determine if they meet all of the necessary requirements. If approved and a visa number is available, applicants physically present in the U.S. may then submit a Form I-485 Application for Adjustment of Status in order to become a lawful permanent resident (LPR). If a visa number is available at the time of filing the I-140, then the I-140 and I-485 may be filed concurrently. If the applicant is outside of the U.S., then they may apply for the immigrant visa at an embassy or consulate abroad.
