Proposed Rule Could Introduce Significant Fees for F-1 OPT Recommendations
The Department of Homeland Security (DHS) has proposed a regulation that would require U.S. universities to pay $70,000 when recommending an F-1 student for an initial period of Optional Practical Training (OPT), followed by a $30,000 fee for each subsequent OPT recommendation. Universities would be allowed to recover these expenses from the student or their employer.
The agency plans to accept public feedback for 30 days following the proposal’s formal publication on October 8. The measure would not take effect unless DHS reviews the submitted comments and issues a final rule. If adopted, the proposal is likely to face legal challenges.
