Federal Court Blocks Enforcement of $100,000 H-1B Fee

A federal district judge in the Northern District of California has issued an order temporarily preventing DHS from collecting the $100,000 fee imposed on certain H-1B petitions. This marks the second court ruling to block enforcement of the fee while legal challenges continue.

The earlier restriction was issued in June and subsequently upheld by an appellate court in July. The latest decision adds another legal obstacle to the government’s efforts to enforce the fee.
