Today we’re here to discuss what an entrepreneur parole is, who is eligible for it, and the duration of the entrepreneur parole so that you have more knowledge about it.
The U.S. Entrepreneur Parole program allows foreign entrepreneurs to temporarily live and work in the United States. Through the International Entrepreneur Rule (IER), the Department of Homeland Security (DHS) grants this temporary stay to entrepreneurs whose business ventures are expected to provide significant public benefits, and who meet the criteria set by the DHS.
This program permits entrepreneurs to stay in the U.S. for up to five years to develop their startups, with the goal of creating jobs within the country. Unlike traditional visas tied to specific job roles, the IER parole program is open to all professional fields. Applicants must demonstrate the potential economic benefits and job creation of their startup.
Entrepreneurs can receive an initial 30-month parole period, during which they can live and work in the U.S. with their families. This is not a traditional visa, but it allows founders of companies with U.S. grants or investments to work in the country without needing an H-1B, O-1A, or green card.
Under this program, entrepreneurs can only work for their startup. Their spouses and children may also be eligible for parole, with spouses able to seek work authorization, though children cannot. Up to three entrepreneurs per startup can be granted IER parole.
Eligibility requirements for the IEPP include:
• A significant ownership interest in a U.S. startup established within the last five years that has potential for rapid growth and job creation.
• A central and active role in the startup, contributing significantly to its success.
• Demonstrable public benefit to the U.S., shown by significant investment from qualified U.S. investors, substantial awards or grants from government entities, or other compelling evidence of the startup’s growth potential.
• Merit for a favorable exercise of discretion.
For a spouse or child to be eligible for parole, they must independently qualify based on significant public benefit or urgent humanitarian reasons and merit a favorable exercise of discretion.
